We had our board meeting tonight and it was reveled that Mr. Kaufman hasn't got his affairs in order. So, he has now asked to delay the expected purchase date by a week or so.
Also a petition has gone around with some 40 or so signatures to have another meeting within 30 days in hopes to get the amended park rules approved sooner.
Also, to give a heads up, there will be a request to allocate probably some $30,000 to purchase new equipment and replace some commonly used items by the maintenance personnel. since the maintenance dept is being stripped of nearly everything by the current owner. So that's on the agenda too, to be approved by the members.
So we're looking into scheduling that, most likely for an up coming Tuesday evening. Of course more folks will have to attend than were there at the end of the last meeting. 51% or more need to be there or we'll still be in the same boat. So talk it up with your neighbors, and we'll be able to get this done.

Also, wasn't the purchase of this equipment already allocated in the budget? I thought when we at the meeting, it was stated we were getting some of the bigger items, in fact most of them. Please clarify.

hi, thanks for wanting to sign the petition. The man from Cedar streetthat did this only needed 40 signatures to get the ball rolling and he did. He gave it to me and now we need to get the hall arrange the interpreters, print notices and get them out to the members. What would be helpful is to speak this up with friends and neighbors. We will need a majority in attendance or we won't be able to pass the rules.

I agree with the above about the $30,000. That was gone over at the meeting and was supposed to be included in the budget as I understood things. Is this an additional $30,000 needed or is this just a case of we need to vote to approve the purchase out of funds already allocated to this need?
If this is another $30,000 that is being asked for it is going to cause one major hailstorm of protest. Is Mark Kaufman leaving ANYTHING here? Also, what in the world could they possibly need that will cost $30,000?
We were told that all the motorized and heavy equipment was staying and that basically it was the smaller hand tools( i.e.; rakes, shovels, etc... )that were needed. $30,000 in small hand tools?
We need more info at the meeting. A very specific break down of what is being asked for, why it is needed( obviously we all know what a shovel is for ), and how much these items cost if this is a request for another $30,000. If it is just a case of needing voter approval to authorize the use of funds already covered that is different.
If this is a request for additional funds not covered in the budget as approved look out. Things are going to really blow up. $30,000 is a LOT of money and it is going to impact the rent which is the bottom line people care about. We haven't even paid our 1st rent as a co-op and now we are talking about possibly raising it and also raising the budget just a few days after we approved it. That kind of thing, if accurate(?), is not going to sit well at all with anyone. The naysayers as well as supporters of the board like myself.
I am not attacking the board over this either. Just pointing out that they need to approach this subject carefully and be very specific and clear about what, why, and how much if it is an additional $30,000. I think it would also be very beneficial if the members could be informed as to how the figure was reached. Were bids solicited for the tools needed or did someone just go to one place and price out what was needed? That kind of information would be very helpful.
I would also be curious to know if Mr. Kaufman is paying a penalty for these delays as we would have been had it been the co-op's fault that the sale was delayed? The co-op was subject to more than $8000 a day in fines for delays to the closing date. This could impact the sale as interest rates could rise and the 6.59% could go up. That means the rent goes up. This is very disturbing news to me and I feel Mr. Kaufman should be fined for this if it is legal/possible to do so.
No one has come by here with a petition seeking a member's meeting sooner than the scheduled one in September. If they do I will sign. We need a meeting sooner and that is very obvious even with the room and interpreter fees we will have to pay. Just need to do it.

About the petition: It will not be going around anymore, as the person doing it got the required minimum number of signatures to call for a special meeting. Thanks for being willing to participate.
Regarding the maintenance needs:
The request for permission to spend $30k is not something additional. There are funds allocated for this, the issue is the amount is over the $3,500 threshold for one dispersement. So the membership should be aware that right away we need to restock the maintenance garage with valves and conduit and piping and tools like rakes and shovels and a commercial grade metal detector (to find buried pipes/valves) and a bunch of other stuff like spare pump motors that must be available right away when a problem occurs. They also want to purchase a good used truck; as the one that is staying has developed weaknesses in the transmission and it's not big enough for the sander that is being left. The maintenance shed is being stripped... we heard that they are even taking the heating system out. I haven't gotten confirmation on that so it's a rumor right now. The only things staying are what is literally written in the purchase and sale agreement. The biggest and best equipment is going.
We also heard they're planning on removing much of the stock piles of sand and loam and crushed stone etc. Again no confirmation, just what Richard has observed going on at the maintenance area.
So we are starting nearly from scratch.
As far a Mr kaufman's delaying the signing is concerned; the the language of the P&S aggreement created by his lawyer(s) was written in his favor. The penalties were stipulated against us for being late, no one expected he would delay it. He is the one selling after all. We had to meet his terms which as you know didn't allow for us to negotiate anything less, as he had another buyer willing to meet the terms. There are a lot of things that haven't been fair or reasonable from our standpoint on this deal but we're pretty much powerless to do much about it.
I really think that the board is doing a great job with this. Especially with all the negativity that is going around. People need to realize hey are looking out for US.

Does not surprise me at all the Mark Kaufman is taking everything not nailed down. Too bad we don't have some recourse to stop him. Taking the heating equipment from buildings that go with the sale however seems to me like he is taking liberties that the P&S agreement doesn't allow for. I know it would cost too much to fight him but man I sure would like to see us try/bluff. At the least he should be confronted over such acts if they are in fact true.
I don't believe he has the right to take things such as the heating system which are part of the building that goes to the co-op in the sale. That really should be investigated vigorously.
Has anyone considered that the delay he has caused/requested is just to give him more time to swipe more stuff?

Wait....he's takeing a heating system out of a building that will be part of our co-op? That is not right. Isn't there anyone we can go to to find out if he can do that? i mean once this is all done, that property will be ours, right?
I just realized...so much for having the other tree removed from my yard...its been marked for 2 years now, he was suposed to take care of that...Oh well.
I dont understand something. the P&S he has with Morgan was for 15. something million and it included heavy equipment, wasnt our P&S the same?
To the BOARD..please inquire about the heating system in the main..bldg..
When we buy a house or a business buys another business, usually, the heating system is left there...come on, what the heck is he going to do with it? Is he being spiteful?
So, Please, for the people that have the knowledge and means, check this out and please clarify on this blog what the exacts are..this is ridiculous..
